  • Section 125.01 F.S. outlines County authority to
    • Prepare comprehensive plans
    • Establish, coordinate and enforce zoning as needed for the protection of the public
    • Adopt ordinances and resolutions necessary for the exercise of its powers
  • Can be applied to oil and gas for Charter and Non-Charter counties. Must be in compliance with county charter if applicable
  • Chapter 162 (Counties) and 163 (Community Planning Act), Florida Statutes


  • Section 377.24 F.S. prohibits
    • Drilling of gas or oil well within the corporate limits of a municipality unless the governing authority has approved the application by resolution
  • Chapter 166 (Municipalities) and 163 (Community Planning Act), Florida Statutes
    • Recognizes broad authority of municipal officials to plan for and regulate the use of land.

What local communities can currently do

Today, local governments may address oil and gas activities through the adoption of zoning ordinances prohibiting well stimulation or drilling in incompatible locations.
